Romania - Draft legislation on mandatory real time reporting from 1st January 2024 and e-invoicing from 1st July 2024

The Romanian Ministry of Finance has recently published draft legislation proposing a first phase of mandatory real time reporting system of invoices (irrespective of their format) from the 1st of January 2024, followed by mandatory e-invoices from the 1st July 2025.

It is proposed that starting from 1st January 2024, all taxpayers, both established in Romania as well as Romanian VAT-registered taxable persons are required to report all invoices for B2B and B2G supplies of goods and services with place of supply in Romania through the national electronic invoice system, named RO e-Factura, within 5 working days of issuance. Exports and intra-Community supply of goods are not included in this requirement.

A grace period of 3 months is granted, during which penalties are not imposed in case of failure to comply with the above obligation. Sanctions will start to apply from the 1st April 2024.

The second stage is proposed to commence from 1st July 2024, when the system will shift to a full pre-clearance electronic invoice submission via the eFactura platform. This system will perform basic validation checks on the information and format of the e-invoices, before transmitting them to the Romanian VAT registered customers. Thus, after 1 July 2024, invoices in paper or in the old electronic format will no longer be acceptable under Romanian legislation and invoices will need to be issued electronically, in XML format and sent via the RO e-Invoice system.
